By accessing and using the content, material, and services of PsychPoint.com, you agree to fully comply with and be bound by the following Agreement each time you access PsychPoint.com.

Please carefully review the following Terms and Conditions.

This web page represents a legal document and is the Terms of Service and Use Agreement ("Agreement") for PsychPoint.com ("PsychPoint"). This Agreement was last updated on October 29, 2019.

PsychPoint holds the right to change, modify, add and omit any or all portions of this Agreement at any time.

You must be at least 18 years of age to access PsychPoint.

Indemnification

You are solely responsible for any losses, claims, legal cases, costs, expenses, judgments, settlements, or damages to PsychPoint as a result of your own use, misuse or negligence of PsychPoint, or any violation against this Agreement. This includes, but is not limited to:

Accounts, Fees and Payment

  1. You may only sign up for your own account. You may not signup for an account that is not your own with your own credentials or other credientials that are not your own. Any person, entity, or practice who signs up for an account that is not their own may be subject to legal action at the discretion of PsychPoint. The falsified account will be marked as inactive on detection and any remaining account balances will be forfeited to PsychPoint.
  2. You may only hold one active account. Duplicate accounts will be deleted.
  3. PsychPoint accounts are available to purchase. Accounts offer access to digital downloads of PsychPoint material. Valid and active credit card payment information is required for access to any account. Payment information is used for automatic payment upon signup and will be automatically renewed for a yearly billing cycle until canceled.
  4. Valid and active credit card information must be provided at the time of the activation of any account. Any account may be deactivated in the event that payment is suspended or otherwise interrupted. If your subscription is inactive, you may re-activate your account at any time by logging back into your account and submitting valid and active credit card information on the activation form.

Termination

PsychPoint holds the right to terminate an account, with or without notice, if there is evidence of misuse of PsychPoint, including but not limited to: using PsychPoint as a means for advertising without permission, posting fraudulent, misleading, or otherwise inappropriate content to PsychPoint, or compromising the integrity of PsychPoint by means of rumors, spreading erroneous or false information about PsychPoint, releasing confidential and client information, compromising the ethical, moral or legal wellbeing of PsychPoint.

If you choose to cancel your account, your account will be deactivated. Any request for refunds of fees paid will be reviewed according to the conditions under the Refund Policy section of this Agreement.

Any halting, interruption, or suspension of payment for an account with PsychPoint will result in immediate deactivation of the PsychPoint account. The account may be re-activated only after payment has been settled with our billing department.

We may terminate your access to PsychPoint, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Eligibility Requirements

  1. You are only permitted to create an account if you hold an active professional mental health license. The license must be active the time of the creation of the account.
  2. It is the responsibility of the professional to maintain a professional license. PsychPoint is not responsible for any false, outdated, or incorrect information that is stored in your account.
  3. If for any reason your professional license is terminated, suspended, or otherwise rendered inactive, it is your responsibility to alert PsychPoint of the changes. Failure to do so may result in the deletion of the account and may result in legal action by PsychPoint.

Any attempts to falsify license mental health professional credentials and download worksheets will result in account termination on detection and forfeiting any remaining account balance to PsychPoint. This may result in legal action by PsychPoint.

Disclaimer

  1. The content provided and displayed on PsychPoint is for informational purposes only. It is not to diagnose, treat, or otherwise be used or accessed for professional advice for individual cases.
  2. It is the responsibility of the consumer to use PsychPoint responsibly and evaluate the accuracy, professionalism, completeness, and accuracy of PsychPoint’s contents.
  3. Seek the opinion of a mental health professional if you seek advice about the evaluation of the content provided on PsychPoint. Do not rely solely on the content provided with PsychPoint.
  4. PsychPoint is not responsible for interruptions of service or unintentional viruses spread through PsychPoint.
  5. PsychPoint does not warranty PsychPoint to error-free or without outdated content.
  6. You are solely and completely responsible for any content or post you make or share on PsychPoint. PsychPoint does not claim responsibility for any misuse, fraudulent use, negligence, or misrepresentations posted from users. You are solely responsible for consequences that arise from your behavior and activity or inactivity on PsychPoint.
  7. PsychPoint is not responsible for the monitoring, screening, supervising or other intervention or surveillance of users’ materials, posts, or activity.
  8. You are solely responsible for professional and ethical misconduct within PsychPoint. It is your sole responsibility to ensure that your activity on PsychPoint remains within the legal and ethical grounds of practice and behavior.

Intellectual Property

All original content, features, functionality, materials, tools, discussions, and other intellectual property are owned solely by PsychPoint and are protected by international copyright, trademark, patent, trade secret and all other intellectual property laws and proprietary rights laws.

Mental health worksheets, assessments and therapeutic materials available for download on PsychPoint.com are only to be used by and under the supervision of licensed mental health professionals with their clients. Worksheets and therapeutic materials are not to be used for self-help, self-diagnosis or any other use unless under the supervision of a licensed mental health professional.

Without an active subscription, only 3 worksheets in a 24 hour may be downloaded by licensed mental health professionals for personal use only.

Worksheets and therapeutic materials are not for advertising and are not to be downloaded and re-posted nor uploaded on any external websites, by students, mental health professionals, non-mental health professionals, unlicensed mental health professionals, or the general public, even if you have an active or inactive subscription.

Redistribution

Downloading content or worksheets from PsychPoint and redistributing the content, including but not limited to articles, content, images or worksheets is strictly forbidden.

Any copying, fraudulent distributing, uploading, fabrication of content, plagiarism, or copyright infringement of the content or worksheets on PsychPoint may result in the immediate deactivation of accounts and legal action by PsychPoint.

Subscription

Purchasing a subscription on PsychPoint does not give the user rights to own, resell or redistribute PsychPoint worksheets.

A subscription only allows for immediate access to worksheets within our members area. A subscription does not grant a license or right that gives any user rights to redistribute PsychPoint worksheets but only allows for immediate access.

Worksheets or therapeutic materials are only to be stored on the local computer of the licensed mental health professional who signed up for a subscription.

Subscription Renewal

Therapists who sign up for an account agree to an automatic yearly renewal fee for their subscription. PsychPoint will use the payment information stored on your account to automatically process payment for your yearly renewal at the beginning of your new subscription period. If you do not want to renew your account, you must cancel your subscription before the end of the current subscription period by logging in to your account, click on “Settings”, clicking Cancel Subscription, then click the "Cancel Subscription" button.

Cancellation Policy

A PsychPoint subscription may be canceled at any time by the account holder through their Members Area. The account holder is responsible to cancel their account if they do not want to be charged a yearly renewal fee. If you choose to cancel your account, your account will be immediately deactivated. Any request for refunds of yearly fees paid must be made by contacting PsychPoint support and will be reviewed according to the conditions under the Refund Policy section of this Agreement.

Refund Policy

Therapists who cancel their account with us may request a refund only if they have not downloaded any PsychPoint worksheets or other PsychPoint material. Due to the nature of our services, it can take up to 5 business days for PsychPoint to issue a refund and 5-10 business days to show up on your statement.

Our system logs which downloadable materials have been downloaded. Refund requests on accounts that have downloaded any downloadable materials including PsychPoint worksheets will be denied. We operate on a "good faith" principle that our users will not create an account, download downloadable materials then request a refund. We will refuse a refund request if this policy is being abused.

In case you have received a refund, you are required to delete all the downloaded PsychPoint worksheets and PsychPoint materials from your hard drive.

Any abuse of our system may result in a debt to the account holder. We may report the debt to credit reporting agencies and make every attempt to collect any funds that are owed to PsychPoint.

Links To Other Sites

PsychPoint may contain links to third-party sites that are not owned or controlled by PsychPoint.

PsychPoint has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or programs that we may or may not be participating with. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Limitation Of Liability

PsychPoint is not responsible for any punitive or consequential damages incurred by you that indirectly resulted from or in connection with the use of services provided by PsychPoint.

To the fullest extent permitted by applicable law, PsychPoint will not be liable to you under any theory of liability—whether based in contract, tort, negligence, strict liability, warranty, malpractice, misuse of content, or otherwise—for any indirect, consequential, exemplary, incidental, punitive or special damages or lost profits, even if PsychPoint have been advised of the possibility of such damages.

The total liability of PsychPoint for any claim arising out of or relating to these Terms or our services, regardless of the form of the action, is limited to the $99 paid by you to use our services.

Governing Law

This Agreement and the rights of the parties hereto shall be governed by, construed, and enforced in accordance with the laws and state of Tennessee. Each party irrevocably consents that any legal action in respect of, or concerning this Agreement shall be litigated solely in Nashville, Tennessee, and both parties consent to jurisdiction of the person and venue solely in Nashville, Tennessee. Each party waives any right to trial by jury in any action, claim, suit, or proceeding brought to enforce, defend or otherwise interpret, evaluate and determining the rights, terms, conditions, or other content relating to or in connection with these terms of use.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on PsychPoint. Your continued use of PsychPoint after any such changes constitutes your acceptance of the new Terms and Conditions.
